E-Mitigations/ Contested

Zillah Municipal Court, pursuant to IRLJ 3.5, authorizes those who have received an infraction to present a written statement in lieu of appearing in court at a scheduled hearing, either to contest the infraction or explaining mitigating circumstances.

Mitigating an Infraction:  If you choose this option, you are admitting that you committed the violation(s) but would like the court to consider the circumstances and are requesting that the fine be reduced.  This is your opportunity to tell the Judge your side of the story.  You may submit additional supporting evidence (i.e. pictures, additional witness statements, etc.) to the Judge for his/her review.  If the violation for which you were citied is a traffic offense, as identified on the front citation you received, it can appear on your driving record.

Contesting an Infraction: If you choose this option you are denying that you committed the violation(s).  You must submit a written statement and may submit any supporting evidence you feel is relevant to explain why you do not believe that you committed the violation(s). If the violation for which you were citied is a traffic offense, as identified on the front citation you received, it can appear on your driving record.

Regardless of the option you choose, your case will be scheduled for a court date.  You do not need to appear.  At that time, the Judge will review your submissions and make a decision about your case.  You will be notified of the court's decision via mail. You may also call in after the hearing to find out what the Judge decided.
